TERMS AND CONDITIONS RELATING TO YOUR SUBMISSION:

eMedia Investments and Platco Digital (Pty) Ltd which operates the Openview DTH satellite platform (“we/us/our”) highly values our audience and the communities we reach. We are asking our viewers to nominate beneficiaries who need assistance. By accessing this website and making a nomination you have accepted these terms and conditions. :

 

  1. DEFINITIONS
    1. “Act” means the Protection of Personal Information Act 4 of 2013.
    2. “Personal Information” means any Personal Information as defined in the Act and any other additional data that you are required to provide in order for the Service to be effectively rendered
    3. “Submission” means the submission you make on behalf of an organisation/initiative/charity for assistance.
    4. “Submission Form” means the online form accessible on our Website used to make a Submission.
    5. “us” “we” “our” means eMedia Investments (Pty) Ltd.
    6. “Website” means the website used to access the Submission Form.
    7. “you” “your” means the customer or viewer who makes a Submission on the Website.

 

  1. OPENVIEW DISCRETION:
  1. Openview retains full discretion with regard to which Submissions will be chosen.
  2. By completing a Submission Form, you acknowledge that there may no cause of action, liability or any blame whatsoever attributable to us for any reason whatsoever, including if your Submission is not chosen.
  3. OpenView will consider each Submission on its own merits.
  4. You acknowledge that we cannot be held accountable for not choosing a certain organisation/initiative/charity and that this is ultimately in our sole discretion.

 

  1. CRITERIA USED BY EMEDIA TO SELECT CAUSE/S:
  1. Preference is given to causes/initiatives administered by a Non-Profit Organisation (“NPO”).
  2. We will choose Submissions in accordance with the following criteria:
    1. the cause/initiative must align with our values, including honesty, transparency and accountability.
    2. the cause/initiative must be directed towards those in need of assistance, where other solutions and paths have either been unsuitable or failed.
    3. Examples of causes/initiatives include (but are not limited to) the following institutions in need of assistance: schools; community centres; old age homes; orphanages; soup kitchens; feeding schemes.
    4. There must be a readily available liaison officer (or someone with similar designation) with whom we can communicate with and who will promptly respond to communications. e. Preference will be given to NPOs.
  3. All submissions are carefully considered by us to align with the criteria stated above.

 

  1. PROTECTION OF PERSONAL INFORMATION ACT 4 OF 2013 (“POPIA”) COMPLIANCE:
  1. In accordance with POPIA, we are processing your information in a minimalistic manner. The purpose for which the information is collected is for us to decide on a suitable cause/initiative.
  2. The information provided will be used only for the reason of selecting an appropriate cause/initiative. You acknowledge that if you are chosen, you and/or your nominated organisation will avail themselves to engage in publicity related events before, during and after the cause/initiative occurs. The organisation chosen will avail themselves to participate in interviews relating to the cause/initiative before, during and after the cause/initiative occurs.
  3. The information is stored in accordance with at least generally accepted industry standards relating to storage and retention. We use technical and administrative security measures such as but not limited to firewalls, encryption techniques, and authentication procedures, among others, to maintain the security of your Personal Information.
  4. We will not sell, publish, or share your Personal Information with third parties for their marketing purposes.

  1. You consent to us collecting and processing the Personal Information you submit to us on the terms set out below.
  2. Personal information collected via the Website is controlled by eMedia Investments (Pty) Ltd at 4 Albury Road, Dunkeld West, Johannesburg.
  3. The use of the Submission Form is not intended for users who are below the age of 18. We do not knowingly collect Personal Information from these individuals.
  4. Subsequent to your Submission, we may request or receive other Personal Information such as feedback, questions, comments, suggestions, or ideas to better achieve our goals. In such instances, you will be given the opportunity to provide or decline that information.
  5. We may make use of cookies to track your use of the Website and Submission Form .
  6. We may update or amend this Privacy Policy periodically and in our sole discretion.
